102 King Street - Informal Meeting
Present:  Paul Bergman, Bergman & Assoc. ; Dan & Robin Wright

Informal Discussion opened at 7:05 pm.  Paul Bergman prepared the plan for the Wrights.  He said, except for the blueberry bushes, it’s pretty much open field.  There is currently a paved way from King St. down the hill, that accesses Fiore property via a 54’ easement.  They surveyed the property, done soil testing with Joe Tevald, had wetlands flagged, researched town hall and Salem Registry of Deeds.  

The plan is for a residential (7 lot) subdivision.  All lots work from zoning, frontage, lot area, footprint coverage, etc., but they are not set in stone yet.  This is just a conceptual plan.   M. Dempsey asked him to  describe any wetlands issues.  P. Bergman showed a manmade pond on the map.  He said Michael Seekamp discussed improving the pond because it’s been somewhat neglected. There’s an area that bisects the property which is currently mowed, keeping the vegetation down.  Seekamp has proposed with this project, improvement of the wetland, possibly expanding it, cleaning it up and making it more defined on both sides of the road.  Possibly with plantings more conducive to that wetland to serve some purpose.

There is a 12’ paved driveway that Fiore uses for commercial and pony rides, etc.   He said the paved driveway would be taken out as part of this project.  Fiore would access his property by the public right of way, and then have easement to access his lot.   

P. Bergman talked about low-impact design, green engineering,  treatment swails, treating storm water at real time.  It gets away from collecting storm water, putting into basins, concrete pipes and dumping into detention ponds.  He said there’s a lot of stuff that gets flushed off the roads into catch basins, ie salt, pesticides, herbicides, animal waste, heavy metals.  This low impact design is gradually becoming part of wetlands protection laws and subdivision laws addresses treating storm water at the source.  The water would hit the road, go to the side into a grassed treatment swail (no curbing). The swail would have a rock under drain.  He believes they have the right soils at this site to do this.  

M. Dempsey said he likes anything they can do to improve the wetlands and the environment.  He also asked for the delineation for 100’ from homes on either side of property.  Informal hearing ended at 7:40 pm.

138-170  Seven Star Rd.
Present:  Bob Arekalian, Groveland Highway Dept.

Hearing opened 7:45 pm.  Groveland highway dept.  B. Arekalian submitted green cards and tear sheets.  M. Dempsey told him ConCom received  2 complaints from abutters that they were not notified.  B. Arekalian said it would be paved in another week or so.  

M. Dempsey said on 7/16/05 he went to visit the site and issued an Emergency Order to the Highway Dept. to fixed the stone culvert and cement culvert.  B. Arekalian said they put in a dewatering well right next to the culvert and circulated the water that was backed up.  He said the stone culvert was from 1800’s, it was eroded, had no bottom, no footing.  They took the tree out that fell over.  All that is left to do is pave it.

The abutters that came in said they were happy with the work and that it relieved the water and protected the environment.  He said they wouldn’t reclaim until next year, but he’ll patch and put a shim coat  3/8” hot top.  M. Dempsey said if he reclaims, ConCom wants him to put in erosion controls, to go the entire length, and both sides, from Holly Lane to Tallyshire.  If reclaiming needs to be done,  an amendment needs to be filed, and a hearing for the amendment held, and the additional abutters notified.  

M. Dempsey said to continue the hearing.  B. Arekalian will have letters sent out to people who weren’t notified.  M. Dempsey made a motion to continue the hearing to September 7, 2005 at 8:00 pm.  T. Grim 2nd.  All in favor.  Unanimous.  

M. Dempsey requested that B. Arekalian look into the cost of providing the Conservation Commission access to the Pictometry software program. Hearing closed 8:06 pm.

182 Washington St.
Present:  Barry & Betty Gorski - hearing opened 8:10pm.

Submitted check, financial form, and permit application.  B. Gorski plan to remodel their home, put a 2-bay (1 bay-turned-family-room, previously existed) garage on back of the house and open up the house.  There will be no additional rooms or bedrooms.  There is a road between her lot and the pond.  B. Arekalian will advise how close the Gorski’s home is to the pond for the record.  M. Dempsey signed the building permit.  Hearing closed 8:26 pm.

752 Salem St.  - Mr. Holt did not contact DEP and did not provide ConCom with a DEP file number.  M. Dempsey continued the hearing until September 7, 2005, at 8:30 pm.  

214 King St. - NOI  
Present:  Alicia Raddatz, Larry Lusignan.  Hearing opened 8:32 pm.  

NOI is for an attached garage within 100’ and they are asking for a waiver for the 25’ no cut and 75’ no build.  J. Termini and T. Schaefer went on a site walk.  T. Schaefer said their only concern was if fill or something  was taken out, that there be no stockpiling.  

A. Raddatz said this plan reflects the revision of 26 x 38 new size of addition.  270 sq ft of additional impervious area, 880 sq ft total.  T. Grim asked what are plans for drainage, ie gutters?  L. Lusignan said no, not on the garage.  It will run off the same way as the roof.  M. Dempsey made a motion that ConCom waive the 25’ no cut zone and 75’ no build zone on  this project for hardship reasons.  T. Schaefer 2nd.   T. Grim abstained.  3 for. 1 abstain.  Motion passed.  

M. Dempsey made a motion to close the hearing, and issue an OOC on the NOI filing. S. Benanti 2nd.  3 for. 1 abstain.  T. Grim abstained.  Motion passed.   M. Dempsey pointed out part of the OOC will include: that the stockpile be kept between the house and  the driveway, that erosion controls will be put in as shown on the map, with silt fencing and hay bales an additional 10’ along driveway.  The applicant has also been made aware of the November-April 15th seasonal restriction.  Hearing closed 8:46 pm.

ConCom Business - M. Dempsey made a motion accept the minutes from July 20, 2005 as submitted with no changes.  T. Schaefer 2nd.  All in favor.  1 abstain.  Motion passed.

97R King St. - ANRAD Continued  
Present:  Marc Jacobs, Alicia Raddatz, Steve Sawyer, Oak Engineers

Hearing opened 9:03 pm.  Tom Schaefer recused himself from this hearing because he is an abutter.  Applicant previously agreed to waive rights under Mullins rule.  ConCom’s consultant reviewed the filing and Marc Jacobs is here to report on that.  Steve from Oak Engineers did the survey, mapping and located flags on multiple occasions.  A. Raddatz working with Patrick (Seekamp) and Lori and they concur with the line shown on the plan, is what they saw in the field.  

M. Jacobs reviewed the exam by Seekamp and concur with the findings for the intermittent stream.   A. Raddatz said she has ten days of pictures showing it dry and not flowing, proving it is an intermittent stream.  She will send ConCom a color copy of those pictures for our file.  An abutter asked is she took pictures from the swamp that’s creating them?  He said there are ducks there, and a lake that had never existed before.  M. Dempsey explained to the abutter that they are taking pictures of the dry area because the rules for perennial vs. an intermittent stream are treated differently under the law.  He also mentioned the paper that was Filed at the Registry of Deeds regarding the agreement with the Zoning Board of Appeals that they were not going to build anymore.  M. Dempsey reminded everybody that the reason for tonight’s meeting is  determining where wetlands are on a piece of property.  

Another abutter (17 Pinewood Lane) said behind her house she never had water, but now behind her house there is water and it’s just sitting there.   M. Dempsey explained to the abutters that Marc Jacobs works for the Town of Groveland, and is available to be asked questions regarding the wetland boundaries, or the determination.   M. Jacobs said their concerns would be more appropriately addressed during a future NOI if an NOI is filed on this property.  An abutter said he‘s concerned about poisons from the septics and sewers draining.  M. Jacobs said that is a Board of Health issue.  

M. Dempsey asked if any abutters have questions regarding where wetland boundaries are.  An abutter asked what the light green portions of the map were.  M. Jacobs said there were four isolated wetland areas.  He said 1,403 sq ft. is not protected under local bylaw and is not a jurisdictional resource area.  M. Jacobs prepared and submitted a final report and recommends that we approve the filing and is happy with all amendments to wetland delineations.  

An abutter asked that they extend wetlands boundaries beyond what’s owned by Mr. Bowden.  A. Raddatz said it’s important to approve just what’s on  the property owned by Mr. Bowden.  M. Jacobs said it would be addressed during a Notice of Intent.  M. Dempsey said the states’ definition of an ANRAD hearing is a determination of the wetlands on the property that is listed and not outside of that.  

M. Dempsey made a motion that ConCom accept the wetlands delineation as presented to us tonight by the plan of Oak Engineering, dated today, August 17, 2005.  T. Grim 2nd.  All in favor.  3 yes.  1 recused non-voting member.  Motion passed.  Hearing closed 9:34 p.m.

ConCom Business - Monday,  September 26, 2005, there will be a Selectmen’s meeting with someone from town counsel regarding conservation land.  

T. Grim made a motion to adjourn.  S. Benanti 2nd.  All in favor.  Unanimous.  9:38 pm.
