Present:  M. Dempsey, J. Termini, S. Benanti, T. Grim

Meeting opened at  7:03 p.m.  

ConCom Business - Minutes
J. Termini made a motion to accept the minutes as submitted by email and present at the meeting, dated September 7, 2005.  M. Dempsey 2nd.  2 yes.  2 abstain.  Motion passes 2-0.

M. Dempsey made a motion to accept the minutes as submitted by email and present at the meeting, dated September 21, 2005.  S. Benanti 2nd.  3 yes.  1 abstain.  Motion passes 3-0.

M. Dempsey made a motion to accept the minutes as submitted by email and present at the meeting, dated October 5, 2005.  J. Termini 2nd.   2 yes.  2 abstain.  Motion passes 2-0.

ConCom Business - 249 School Street
DEP #030-0364, 249 School St., replacement septic system for a single family residence.  Issued Emergency order on 10/7/05.  M. Dempsey made a motion to close the hearing on 249 School St. NOI.  J. Termini 2nd.  All in favor.  Unanimous.  

ConCom Business - Seasonal Restriction Site Visits
Saturday, October 29, 2005.  Seasonal restriction site visits  for 6 active developments of more than 2 houses.  Commissioners discussed hiring. Marc Jacobs to come to the site visits and review the NPDES filings (federal storm water management filings).  T. Grim made a motion that ConCom budget up to $1,000 to retain Marc Jacobs to evaluate the storm water management plans and accompany ConCom during the seasonal rap-up tour and share with us his notes from that tour.  M. Dempsey 2nd.  All in favor.  Unanimous.

ConCom Business - GRDA
Commissioners discussed projects requiring filing GRDA’s.  

Washington Street- GNOI/NOI
Present:  Phillip Christiansen, Christiansen & Sergi; Bob Messina, Johnson Pond LLC; Brian Adams; Fred Burbridge, Lee Road; Mark Snow, Coleman Road

Hearing opened 7:35pm, DEP# 030-0363.  Submitted green cards and tear sheets.  P. Christiansen  mentioned a 40B projects of 16 houses off of Washington St. adjacent to Johnson’s Pond.  The project presented is a new water line from Salem St. down Washington St. towards the 10” line close to Uptack Road.  It would involve replacing the existing 6” with a 12”, and connect to a 10”.  The 10” runs past Coleman Rd. and then they would pick up and extend that portion.  The plan shows hay bales along both sides of the street, backed by silt fence.  

M. Dempsey informed him that the entire area is an extremely sensitive area not only because of the wetlands, but also because of endangered species and that he needs to file with National Heritage.  P. Christiansen said he did file as part of the application, but has not heard from them yet.  M. Dempsey said ConCom knows it’s in a sensitive area and there are tight restrictions.  B. Adams asked what restrictions?  M. Dempsey said ConCom will have someone review what needs to be done.  B. Adams suggests breaks in fence for the critters to cross.  P. Christiansen wants to do the work next spring.  Saturday, November 12th,  9:00 am.  Meet at bottom of Veasey park driveway.  Continued hearing until November 16th 7:30 pm, at Veasey Park.  Hearing closed 7:55 pm.  

94B Main Street - Savory Woods - (did not show)

166 Main Street - NOI hearing continued

Present:  Jon Moll, Attorney; J. McComiskie, 166 Main Street; Mary Clisbee;  John B. Barrenco.
Hearing opened at 8:30 pm.  At the last hearing, we asked J. McComiskie for a couple of things: the 25,50’ 100 buffer lines delineated with flags, mapped out, soil testing, scientific data to prove where the wetland borders are; and a plan for the restoring 25’ buffer zone, including proof of elevation, grading, wetland species on the ground, best estimation of trees that existed within the 25‘ buffer zone.  

J. McComiskie spoke with Tom Keough, but because of the amount of rain, he didn’t get out to the site to finish up.  J. McComiskie asked for a continuance of  two more weeks.  Hearing continued until November 2nd 7:30 pm at Veasey Park.  J. Moll asked on what basis is the work being done, ie the soil testing?  He said there are flags at the stream bed right now.  M. Dempsey told him ConCom is asking for the buffer lines to be delineated, mapped out based on soil testing and scientific data with a plan with proof for grading, elevation, wetland species, and trees.  T. Grim requested that J. McComiskie bring his wetland scientist to the next meeting.  Hearing closed 8:39 pm.   
  
T. Grim made a motion to adjourn the meeting at 8:50 pm.  S. Benanti 2nd.  All in favor.  Unanimous.
