Present:  M. Dempsey, J. Termini, T. Grim, S. Benanti, T. Schaefer

Meeting Opened at 7:19 pm

ConCom Business - M. Dempsey made a motion to accept the minutes from March 15, 2006 as submitted by L. Felch.  T. Schaefer 2nd.  All in favor.  Unanimous.  

245 Center Street  - COC - Andrew Kowsolski - Informal Hearing.  A. Kowsolski submitted his form requesting the COC, he filled out the state form, paid the $250 fee.  All paperwork received.  A site walk is needed to confirm the Orders Of Conditions.  Site walk scheduled for March 25th at 8:30 am.  Informal hearing closed at 7:34 pm.

ConCom Business - Site Visits. M. Dempsey visited Lot 6 Pineau Estates.  The Commissioners looked at the plot plan.  The owner wants to cut some trees for a lawn.  It’s a level lot.  It shouldn’t affect the wetlands.  M. Dempsey will ask for an estimate of trees to be cut.  M. Dempsey made a motion that ConCom allow all the trees to be cut between 50 and 75‘ buffer zone at Lot 6, Pineau Estates as long as it doesn‘t exceed ConCom’s 40% rule and with minimal grading and no backfill.  T. Grim 2nd.  All in favor.  Unanimous.  Closed 7:43 pm.

208 Main Street - GRDA
Present:  Bill Ferguson

Hearing opened at 7:44 pm.  B. Ferguson would like to replace his present deck.  He said the deck was not built correctly and is falling apart.  He plans to take the deck down and put in 3 Sona Tubes and then a new deck.  T. Grim did a site visit.  He said it’s more than 75’ away, but less than 100’.  T. Grim said because of the swail, it doesn’t need erosion controls.  Hand excavation.  J. Termini made a motion to allow him to remove the deck, pour Sona Tubes and rebuild the deck.  He was told not to put any debris in the wetlands.  Subject to wait until April 15, 2006 because of Seasonal Restriction.  T. Grim 2nd.  Debris must be removed within 60 days of commencement of the project.  B. Ferguson is to notify ConCom when he plans to begin the work.  All in favor.  Unanimous.  M. Dempsey will send him a letter.  Hearing closed 8:00 pm.

Change to the Bylaw Language and Discussion of the Fee Schedule -
Hearing opened 8:01 pm.  This hearing was advertised in both the Newburyport Daily News and the Lawrence Eagle Tribune.

Bylaw Language - A paragraph will be inserted that explicitly talks about application fees.   M. Dempsey researched 10 different other town’s bylaws.  Town Counsel will review the language too.    

Our Bylaw is modeled after the Mass Conservation Commission from 1995.  J. Termini suggested having bylaws rewritten.  J. Termini will research the cost.   M. Dempsey suggesting separating standard regulations from the bylaws.   
Fee schedule - This has been in place for the last year.  Fees are kept in relation to what it costs to do the work.  Commissioners discussed the work involved in each fee, ie, initial contact, obtain paperwork, site walks (which can be extensive), reviewing orders, notarizing documents, overhead expenses, etc.   

M. Dempsey made a motion that ConCom accept the language change to the Bylaw.  T. Grim 2nd.  All in favor.  Unanimous.

M. Dempsey made a motion that, after reviewing the Local Fee Schedule, a motion to raise the fee for the GRDA from $75 to $100.  J. Termini 2nd.   Discussion followed.  2 yes.  3 no.  Motion did not pass.  GRDA fee stays at $75.

M. Dempsey made a motion to raise the fee for the Amendment to the Orders of Conditions from $250 to $350.  T. Grim 2nd.  Discussion followed.  All in favor.  Unanimous.
 
M. Dempsey made a motion to raise the fee for Certificate of Compliance (COC)  from $250 to $300.  S. Benanti 2nd.   Discussion followed.   M. Dempsey withdrew the motion.  No vote.   This fee will be reviewed next year.  

M. Dempsey made a motion to close the hearing on bylaws and fee schedule.  T. Grim 2nd.  All in favor.  Unanimous.  Hearing closed at 8:53 pm.

T. Grim made a motion to adjourn the meeting at 8:55 pm.  S. Benanti 2nd.  All in favor.  Unanimous.
