Conservation Commission Minutes 06/21/2006
June 21, 2006

Present:  J. Stewart, M. Dempsey, T. Schaefer, S. Benanti

Visit by Jason Lederer – DEP Circuit Rider
He is visiting all local commissions.  Available for help or training.   

Opened meeting at 7:42 pm.  

ConCom Business – M. Dempsey made a motion to accept the minutes from June 7, 2006.  T. Schaefer 2nd.  Unanimous.  Motion passed.

213 Washington St. – GNOI
Present:  Jim Logan

Storage shed.  Within 100 ft. of pond.  (A line of hay bales 30 feet away from pond.  10 feet from edge of house.)  Moving oil burner.  Replacing tank because it is not up to code.  Has not hired anyone yet until they get the permit.  Will have a fully certified oil dealer.  Call us before work begins to inspect.

T. Schaefer made a motion to approve work at 213 Washington Street to add 8’ x 13’ addition with erosion controls.  A line of hay bales 30 feet away from pond.  10 feet from edge of house.  And a presconstruction call and inspection prior to work.  S. Benanti 2nd.  Unanimous.  Motion passed.   

16 Pandora Drive - GNOI/DEP NOI

In-law apartment and driveway with concrete retaining wall.  Collected green cards and tear sheets.  

View map of site.  Site visit report and pictures.  Read permit issued for October, 2005 replacement of septic system.  

Conditions:

-       Keep the existing hay bales and silt fence.  Add more hay bales at south edge of bales for approximately 15-20 feet.  One top of degrading hay bales.  

-       Call us 48 hours prior to beginning construction.

M. Dempsey made a motion to accept the project at 16 Pandora Drive to add an in-law apartment, driveway and retaining wall within 100’ buffer including exist hay bales, silt fence, and pre-construction call at inspection.  Visit.  J. Stewart 2nd.  Unanimous.  M. Dempsey made a motion to close hearing at 8:15 pm.  T. Schaefer 2nd.  Unanimous.  

4 Marion Ave – GNOI/DEP NOI – Continued from 6/7/06
Dock and pathway.  Opened hearing at 8:18 pm.  

Site walk 6/10/06.  S. Benanti, T. Schaefer, J. Dempsey and T. Grim visited and walked the site.  

On walk, T. Grim noted last bend was rough.  He proposed moving it 50 feet down, making it less graded and smoother.  Also added anchor bars and water stops to plan.  Water bars are stone – applicant.  J. Stewart asked how he would deal with anchoring the dock.  The dock is a temporary dock that doesn’t affect bank.  It is 80 feet out into river – applicant.  These are the same as neighbors 2 docks next door.

M. Dempsey asked how about the hole at the top of the path.  Proposing anchor bars, large rocks, 2 ft. width of path in hole about 10 feet.  Gravel to regrade and strengthen the hill.  No machinery will be used to do the work.

M. Dempsey is concerned with potential erosion particularly with areas of the hill that have slid down.  Applicant assured us he will do the best to protect the hill.  Applicant agrees to cut NO TREES and minimal change to hill.  (Will be put in Orders of Conditions).

No store gravel or mulch on remainder of path.  Wetland there will be minimal impact to erosion and to the stability of the hill.  Dock will replaced to have minimal impact to bank.

M. Dempsey made a motion to accept the project at 4 Marion Ave to place a dock and 5 foot access path within 100 feet of Merrimack.  Preconstruction meeting conditions according to plan.  S. Benanti 2nd.  Unanimous.  

All DEP concerns have been address.  M. Dempsey made a motion to close the hearing at 8:47 pm.  T. Schaefer 2nd.  

He owes us a copy of 6/21/06 plan.

18 Stonebridge/Lot 7 Center St. – Amended Order of Conditions

Map 6/7/05 revised.

Wants to cut down on trees requested every 10 feet 2” diameter maple.  Boulders in place now with 6 foot gap.  

Would require (48) 2 inch caliper trees, new plan would use (16) 1/2” diameter.  32 blueberry bushes.  

The trees and rocks form a significant barrier.  We need a plan that provides a similar significant barrier.  

Continued to July 19, 2006.  He will review plan and drop off before meeting.

T. Schaefer made a motion to close the meeting at 9:15 pm.  S. Benanti 2nd.  Unanimous.
