Conservation Commission Minutes 07/19/2006
July 19, 2006

Present:  M. Dempsey, T. Grim, J. Stewart, S. Benanti

Open meeting 7:20 pm.

Johnson Pond Issue -
Present:  Jim Manganiello

Hearing opened at 7:21 pm.  J. Manganiello said his property is at risk.  M. Dempsey and T. Grim had done a site visit in the past and agreed that something needed to change.  M. Dempsey said the Selectmen told him there was little they could do.  J. Manganiello said he hired a wetland scientist, Steve Erickson, and and Attorney Greg Macgregor.  He has compiled 340 photos.  He says the wetlands are at risk, there’s an unofficial boat launch and parking lot, as well as road runoff.  J. Manganiello said he owns a small pond that’s a wildlife refuge with nesting birds, salamanders, as well as a migratory path for possible species.  There’s leaking oil on ground.  Water comes from the culvert area and it’s unmanaged, inadequate, and floods into Johnson’s pond.  He says there’s no other place in Groveland where there is such a risk to water, wildlife, and the environment.  It’s a fragile wetland resource area.  Police concluded radical significant changes need to be made ie, banning parking and use.  J. Manganiello doesn’t know why the Selectmen are blocking the changes.  He said he doesn’t want to go to court and is appealing to ConCom for protection of the property, water, etc.  

M. Dempsey agrees with him that there is a problem there, however, ConCom doesn’t have jurisdiction.  
J. Stewart asked J. Manganiello if he spoke to the Selectmen.  He said yes, Betty Gorski and another Selectman went to his home.  He’s heard nothing.  He’s called for an explanation and was told they changed their minds.  M. Dempsey said ConCom understands his situation.  J. Manganiello said he’s had 3 mailboxes vandalized, trash barrels thrown into the water, no trespassing signs ripped off, and their trash stopped getting picked up.  Haverhill picks it up now as a gesture of cooperation.  He says he and his wife live under constant duress.  He asked that ComCom bridge a connection with the Selectmen.  M. Dempsey said the Selectmen must deal with it and there is little ConCom can do.  Hearing closed 7:43 pm.  

Lot 7, Center Place/18 Stonebridge Rd, NOI Cont - Amendment to OOC.
Present:  Greg Hochmuth, Neve-Morin, Brandon Arekalian

Hearing opened 7:45 pm.  Re: barrier coming into Lot 7, 18 Stonebridge.  G. Hochmuth said the Order stated 2” caliper between each gap.  Nursery mangers say it’s too close for maple trees of that size.  Blueberry bush is a better barrier and suggested Vibernum Arrowwood being sturdy.  B. Arekalian said the maples would be 2’ off the driveway and have quite an overhang.  M. Dempsey said at the last meeting they had discussed trees and rocks to form a significant barrier.  The plan needs to provide a similar significant barrier.  T. Grim said alternating trees and bushes seems reasonable.  Going to 1” diameter  gives the trees a better start.  T. Grim made a motion that ConCom amend the Order of Conditions by making the following changes to Attachment “V” , Item 5:  First, change between “each” boulder to between “every other” boulder.  Change 2” caliper maples to “1” caliper maples“.  Add, “between remaining alternate boulders, placement of blueberry or Viburnum.”  J. Stewart 2nd.  All in favor.  Motion passes 3-1 (M. Dempsey voted “no“).   

T. Grim drew on the plan where the six sign posts should go.  M. Dempsey made a motion to make the following changes to Attachment V, Item #6:  Removing the phrase, “no less than 2 square feet or no more than 3 square feet in size.”  Adding at the end of the first sentence “and amended July 19, 2006”.  Striking the sentence, “In addition, signs shall be installed every 100’ along the eastern border of the proposed driveway.”  Three monuments can replace a 1” caliper trees between boulders on the driveway.  T. Grim 2nd.  All in favor.  Unanimous.  Hearing closed 8:21 pm.  

Lot 2 Center Place - COC

Present:  Greg Hochmuth.  Hearing opened 8:23 pm.  M. Dempsey referred to C. McKee’s report about the culvert’s part of the roadway NOI.  It showed 3 posts and the order called for 4.  The Order also said “as shown on plan”.  New replication area 25’ no disturb zone actually is 25’.   There is no sign stating “No sodium de-icing compounds“.  According to the Orders there should be a permanent sign designating a no salt zone.  Greg suggested signs at all 3 crossings.  A site visit has been scheduled for  July 24th with T. Grim and G. Hochmuth.  

Lot 6 Center Place - Questioned 3 conditions: signage, number of signs (only 2 markers - should be 3 markers).  Hearing opened 8:32 pm.   Site visit same as Lot 2.  Closed 8:36 pm.  

7 Abbott Circle - COC Question  (not an agenda item)
Present:  Richard York

Opened 8:37 pm.  R. York did not understand the COC project.  M. Dempsey explained the process from the Permit Application to Certificate of Compliance.  R. York will be meeting with C. McKee on Friday.  Closed 8:48 pm.  

21 Garrison GNOI-

Hearing opened 8:49 pm.  Received tear sheets.  Repairs to existing footprint.  M. Dempsey made a motion to accept the project requiring a dumpster on the left side of the house, and a line of hay bales along the stream approximately 30’ from the street up to the corner of the house.  T. Grim 2nd.  All in favor.  Unanimous.  He was told to put the hay bales in place before he does the work.  M. Dempsey will send him a letter.  Hearing closed 9:02 pm.  

N. E. Wildflower Society - GNOI/Invasive Species Removal at Crane Pond

Present: opened 9:04 pm.  They had a permit to do work in 1999, which just expired earlier this year.  M. Dempsey made a motion to grant a new permit to continue work.  T. Grim 2nd.  Motion passed unanimous.  M. Dempsey will send a permit letter.  Hearing closed 9:10 pm.
