Conservation Commission Minutes 11/08/2006
November 8, 2006

Meeting opened 7:20 pm.

ConCom BusinessSign-Offs – Monday night coverage.  
Passed around sign-off sheet for the last six Mondays of 2006.  Commissioners committed to be available on various Monday evenings.

ConCom BusinessMinutes
M. Dempsey made a motion accept the minutes from October 25, 2006 as submitted.  S. Benanti 2nd.  All in favor.  Unanimous.  

ConCom Business - Mass Elec. Road Washout Between Ashcroft Terrace & Baldwin Terrace  
M. Dempsey read from C. McKee’s site visit report about the two sites.  She met with Tim Sullivan and National Grid on November 7, 2006.  There was considerable wash out 4 or 5 years ago northwest of Baldwin Terrace.  Mass Electric had filed and done the repair.  During an inspection, 50’ of the same access road is eroding again.  The washout is within 100’ of wetlands but hasn’t yet affected the wetlands.  

Northwest of Ashcroft Terrace (behind Whitestone II).  It’s an old railroad bed which hasn’t been updated for decades.  15-20’ of the road is washed away.  Work should be done as soon as possible.  

C. McKee presented ConCom with a proposal for them to do the work under a wavier and under an Emergency Order.  They would submit 2 separate filings.  ENSR sent a letter requesting a seasonal waiver for the work.  C. McKee agrees that it should be done.  $500 for 5 days.  .  

Commissioners agree that the work should be done.  J. Termini suggested ENSR provide digital photos before, during and after the work.  All work to be completed by the end of November, 2006.  Fee $500 for five days work.
M. Dempsey made a motion to allow, under an Emergency Order and a waiver from the seasonal restriction for National Grid to perform repair work on an access road northwest of Baldwin Terrace, with all work being completed by November 30th.  J. Termini 2nd.  All in favor.  Unanimous.

ConCom Business - Waiver request – 208 Main Street-GRDA
ConCom received a letter from William Ferguson for 1 day waiver to finish his deck.  He would like to do the work on Saturday, November 11, 2006.  He requested a waiver from the fee as well.  M. Dempsey made a motion to grant a waiver from the seasonal restriction for work on a deck at 208 Main Street to total 7 days between November 9 and November 30, 2006 for a fee of $50.  J. Termini 2nd.  All in favor.  Unanimous.  

368 Main St. – GNOI/NOI cont’d.  
Present~:  Peter Staples

Hearing opened 7:44 pm.  Reviewed the filing.  Natural Heritage said there’s no impact.  M. Dempsey made a motion to close the hearing for 368 Main St. NOI/GNOI for repairing the riverbed and issue a permit to allow the work.  T. Schaefer 2nd.  All in favor.  Unanimous.  

P. Staples asked when he needs to request a seasonal restriction, because the State requires the work to be done between now and March, 2007 (during dormant times when there’s low flow in the river and before the spring rains).  M. Dempsey recommends he send a letter to ConCom requesting a waiver from the seasonal restriction for 4 days and the dates he’d like to do the work.  ConCom will vote on it when we receive his letter.  Hearing closed 7:53 pm.   

ConCom Business - 4 Marion Ave.-Dock
They installed a dock and path but did not do the work as ConCom asked.  After performing a site visit, C. McKee recommends that ConCom allow him to fix as soon as possible and issue him a waiver. Bobcat cut into the hill and nothing was done to prevent dirt from eroding down the hill.  Needs a retaining wall to stabilize the site.  M. Dempsey called C. McKee who provided a report over the speaker phone.  Applicant needs a 1 day waiver.  M. Dempsey made a motion that ConCom grant a waiver from the seasonal restriction at 4 Marion Ave dock to build a wall to prevent erosion down the hill, to be completed before November 30, 2006 at $100 for 1 day waiver fee.   T. Schaefer 2nd.  All in favor.  Unanimous.  

ConCom Business – 860 Salem St.-Chesterton
The project is going well. Work should be finished by the end of next week.

ConCom Business - 1 Main Street – DEP #030-0372.  
M. Dempsey made a motion close hearing for 1 Main Street and issue an Order of Conditions with permit.  J. Termini 2nd.  All in favor.  Unanimous.

ConCom Business – Building a Bridge at Meadow Pond
Jim Andrews requested to build a bridge using 2 long telephone poles at the Uptack Road/Meadowpond area, appx. 100 yards in, at the first widened stream.  There used to be a bridge there, but it fell apart.  The Boyscouts built the original bridge.  ConCom prefers something other than telephone poles be used as a bridge.     

M. Dempsey made a motion to close the meeting 8:40 pm.  .  T. Schaefer 2nd.  All in favor unanimous.
