ConCom Business - M. Dempsey made a motion to accept the minutes from November 8, 2006 as submitted. T. Schaefer 2nd. All in favor. Unanimous.
Lot 1, 4 Marion Ave (Way) – C. McKee recommends sending an enforcement letter, giving him 10 days to do the work. Al Couilliard had agreed to do the work and has not done it: stabilization, cleaning up area by new house, and the retaining wall. M. Dempsey made a motion send a letter requesting compliance with ConCom’s concerns at 1 Marion Way to Mr. Couillard as soon as possible. T. Schaefer 2nd. All in favor. Unanimous.
Community Preservation Committee Proposals - Deadline for submitting a proposal to get funding for 2007 Community Preservation Money is December 29, 2006. One of the projects is to fix the roof at Veasey Park with an approximate cost of $15,000. Another project is to fix the electrical system at Veasey with an approximate cost of $30,000. These will be two separate proposals under Historic Preservation. M. Dempsey made a motion to approve two Community Preservation Proposals to the Community Preservation Committee for funding at Veasey Park to be completed by Veasey management committee to repair roof and electrical system work under historic preservation and issue a letter of support and approval. T. Schaefer 2nd. All in favor. Unanimous.
M. Dempsey made a motion to approve an application to the Community Preservation proposal for Community Preservation Committee funding to purchase 8 acres of open space, which adjoins Meadow Pond Reservation at 28 Uptack Road with the assistance of a third party such as Trust Republic Land or Essex County Greenbelt under Open Space Preservation. J. Termini 2nd. All in favor. Unanimous.
M. Dempsey made a motion to apply for Student Conservation Association MA Park Americorps 2007 project and repair stream crossings on trails and trail work within Meadow Pond Reservation. J. Termini 2nd. All in favor. Unanimous.
Whitestone II – School St. – Request for Extension to OOC

Hearing opened 7:23 pm. Sergio Bonilla said that the development is finished. Mr. Gillis is requesting the extension because they are in the “as built” review process to cover any issues that may come up. They are also trying to clarify with Planning Board to find out if they want to go forward with ground water monitoring wells. They are requesting a one year extension. The monitoring wells would be the only possible work. If they’re in the 100’, they would have to file for those. M. Dempsey made a motion that ConCom grant an extension to Whitestone II to complete work at the site until October 31, 2007. S. Benanti 2nd. All in favor. Unanimous. Hearing closed 7:32 pm.
Chesterton, 860 Salem St. – continued
Present: Neil Leonard, Linda Loreth
Hearing opened at 7:32 pm. ConCom allowed work to fix the swail and stream bed that runs through two of the buildings, to be monitored by C. McKee. Neil Leonard and Linda Loreth came tonight to update ConCom on how the work went. N. Leonard submitted an as built print from the surveyor. J. Termini asked how well it performs. N. Leonard said excellent. He also brought before and after pictures. He said the water is flowing very well. C. McKee inspected the site numerous times and submitted a report and brief synopsis of events that happened.
N. Leonard said the abutters should not have back up of water. C. McKee recommends a final inspection with ConCom board members and issuing a local Certificate of Compliance. She also recommends annual inspection by ConCom. Hearing closed 7:42 pm.
ConCom Business - Use of Granite Markers by Planning Board – John Termini will draft a letter and bring to ConCom’s next meeting regarding the PB’s use of granite markers and their orders to avoid conflict of interest.
ConCom Business – Alternative Erosion Control Technologies - J. Termini brought samples and discussed new erosion control options; ie, bio-nets which are easy to use, fairly inexpensive and comparable to hay bales. They may be a good consideration to use because the rolls are lighter.
25 Pandora Drive – Request for COC
ConCom received a hardship letter requesting a waiver from the normal fee of $250. M. Dempsey made a motion that ConCom grant a hardship waiver and issue a Certificate of Compliance for 25 Pandora Drive. S. Benanti 2nd. All in favor. Unanimous.
Ashcroft Terrace Washout – National Grid Repair - NOI
Baldwin Terrace Washout – National Grid Repair - RDA

Hearing opened 7:51 pm.
ConCom has issued emergency orders to National Grid on these 2 access roads for repairs and also, under that, defacto waiver to the seasonal restriction.
Baldwin Terrace – RDA - Tim Sullivan, ENSR said this is a cross-section right of way between Baldwin Terrace and Main St. He said there was signifact washout appx. 5 years ago. It was built on a historic railroad bed, so it’s elevated. The water appears to be coming from higher ground, collecting, and then using the roadway as a stream channel which is washing sections away. This area is100’ fee long with sink holes appx.1 foot long. The contractor started this morning establishing erosion controls. He installed filter fabric along both shoulders of the road. Built up areas that eroded with with stones, trying to crown it to shed water evenly. J. Termini asked what type of erosion controls they were using. J. Hogan said
bio-degradable chip bales. They are requesting a 1 day waiver. Baldwin Terrace RDA hearing continued until January 10, 2007. Hearing closed 8:04 pm.
Ashcroft Terrace – NOI
Hearing opened 8:05 pm. Right-of-way between School St. and Ashcroft Terrace. Water used the road bed that has a stream channel and eroded it. It failed and sand and rock previously used to build the railroad bed, washed into wetland area next to the right of way. The proposal is to fish out the material, rebuild road to the way it was. The contractor will put boulders in the hole where the embankment failed, and build it back up. Further down, the road has carved itself into a stream channel. It will be graded back to crown. The whole length is appx 300 feet. Culvert headwall has started to fail - black plastic 30” PVC pipe. The headwall has slumped around both sides of it and crushed the end of the pipe and has also pitched in the air by appx 6”-1 foot. The contractor will reset the pipe and put the headwall back so that the pipe can close. Total of 4 days.
M. Dempsey asked if they planned to install or remove any poles. Josh Hogan said there was one pole that was struck by lighting, but that they do not plan to replace it until the spring. No trees to be cut down. J. Termini asked if they have a plan to address problem areas considering the large rain events we’ve had this fall. J. Hogan said they are reactive and take care of things, ie fix culverts, when they receive a complaint. M. Dempsey asked J. Hogan to explain the corporate relationship within ENSR. He said National Grid owns many electric companies, ie, Narraganset Electric, Granite State Electric, etc. They legally do business by the name of Mass Electric because that’s the name of the company that owns the facilities. For the public, they’re
National Grid because they’re one company. For wetlands issues, they hire consultants like ENSR or TRC or other qualified wetlands consultants.
An abutter asked if the whole stretch of road from Ashcroft to Rt. 97 would be repaired. J. Hogan said it would be just areas that have eroded. From the first culvert on Ashcroft to the 2nd culvert where it has washed into the wetlands. An abutter asked if the road would be wider and paved? J. Hogan said it should be approximately the same width (10’-12’) for the trucks to have access. The road would be smoothed out so the trucks can pass through, but it won’t be any wider. The finish will be gravel. They will not pave the right-of-ways. An abutter asked how they plan to keep motorcycles and dirt bikes out? They will put up No Trespassing signs and request that people call the police if they see someone trespassing on the right of way.
There are gates up as well to block access.
Abutter Frank Joyal expressed concern because the collapsing culvert has flooded his property several times, up to 3-4 feet of water. Another problem is the runoff from Ashcroft Circle. He said the washout has been going for 10-15 years. M. Dempsey asked him if he sees something like this, to please report it. T. Sullivan assured Mr. Joyal that he had both the contractor and his supervisor look at it, and that the culvert will be fixed.
Ashcroft Terrace hearing continued to January 10th, 2007. M. Dempsey will contact T. Sullivan to do a site visit on a Saturday before the next scheduled meeting. Abutters will be called for site visit if their name is on the list. Hearing closed 8:25 pm.
