ConCom Business – Minutes
T. Schaefer made a motion accept minutes from 6/11 as submitted. Mike 2nd. 4 yes. 1 abstain. Motion passed.
5 Holly Lane – Informal Discussion
Present: Dan and Tracy Spaulding; Barry Fogel, Attorney with Keegan Werlin; Rich Briscoe
Informal hearing opened 7:17 pm. Atty. Fogel gave a brief summary of this history of the previous septic system project. They’re working with Ben and propose to remove the current system and replace it with another that will be much smaller, much lower and much farther away from wetlands. R. Briscoe gave the Spauldings a proposal to do the work, giving the Spauldings a yard, and achieving more protection, which is at least 50’ from the wetlands. No activity will take place in the slope or in the wetlands.
Atty. Fogel said the Order of Conditions is not yet recorded, and he plans to record both the OOC and COC as the same time with the chain of Title. The as-built will show the deviations from the proposed plan. Ben Osgood, New England Engineering will inspect once a day and will fax to our agent every day while working on it. M. Dempsey made a motion to issue an Enforcement Order for 5 Holly Lane septic system, once presented with new plans and differences. T. Schaefer 2nd. Motion passed.
MEC Right-of-Way - continued
Present: T. Sullivan
Hearing opened 7:50 pm T. Grim wants Agent C. McKee to be on-site while they’re cutting the banks. T. Sullivan said the pole sets would take place in one day. The work will be about two weeks long. Suggests C. McKee come again once all the poles are set. Hearing closed 7:55 pm.
860 Salem Street/Chesterton – GNOI/NOI continued
Hearing opened 7:55 pm. M. Dempsey made a motion to close the hearing on the parking lot improvements at Chesterton, 860 Salem Street and issue the permits. T. Schaefer 2nd. 4 yes. 1 abstain. Motion passed. 7:56 pm.
GRDA 102 King St. – Blueberry Lane – 6 lot subdivision

Hearing opened 7:57 pm. She will need to file individually for individual lots. The plans aren’t final. They might move the road a bit. 100% variance free – 2 sidewalks. ConCom prefers only 1 sidewalk.
R. Wright needs to file a Notice of Intent for the whole subdivision and then for individual NOIs for lots that require them. Lots 3, 4, 5, and 6 need filings. Lots 1 and 2 don’t need individual filings. No site walk done yet. Mike Seekamp flagged the wetlands. Hearing closed 8:15 pm.
Town Forest – Informal Discussion
Mr. Albert Ellis, OHC Development.
Hearing opened 8:15 *S. Benanti recused himself as an abutter. A. Ellis has been contracted to purchase the property Town Forrest Crossing subdivision on Wood Street. He noticed in the OOC that there are 10 lots in which individual orders are required. He will file for individual NOIs for those 10 lots. Delineation has already been done. He intends to file the NOIs before taking title.
They intend to build the A & R lots on Wood Street, and begin the road after May, 2009, then start to build out from the Center Street side. It’s been two years, and some of the present Commissioners weren’t on the Board at that time, so site visits will need to be conducted. He can file all 10 NOIs at once, however, ConCon will schedule them as needed. Informal hearing closed 8:25 pm. *S. Benanti returned to the meeting at 8:26 pm.
Board of Health – Public Safety Discussion
Regarding 0 Rollins Street
Present: Ed Gallagher
Hearing opened 8:27 pm. He has had several complaints about smells in that area. He’s found manure in the road. E. Gallagher went on satellite and saw a brook right beside where they pile it. It’s in a Zone 2, and believes that agricultural manure is required to have a concrete base to pile it on, according to the Manure Management Plan
E. Gallagher said he will write a letter to tell the owner to move the manure from where it is, because he doesn’t have a permit to store it there. Where stored may have been a wetland or pond. The State may have to step in, Department of Agriculture. E. Gallagher will keep ConCom up-to-date on any new information. Hearing closed 8:55 pm.
T. Grim made a motion to adjourn at 9:00 pm. J. Stewart 2nd. All in favor. Unanimous.
