ConCom Business -Conservation Rules
M. Dempsey made a motion to accept the Conservation Rules and Regulations for Conservation areas. C. Keene 2nd. All in favor. Unanimous.
ConCom Business - ConCom Application for Permit or Services Form
The fee schedule has been updated per last month’s meeting on both the paper forms as well as the website.
ConCom Business - ConCom Sign-Off Sheet for OOCs –
T. Grim composed a sign-off sheet to be given when applicant is given an Order of Conditions. Commissioners have encountered people who claim to be unaware of, or think things (particular orders) don’t apply to them. Commissioners discussed editing parts of the form. T. Grim will revise the document to make it part of the permit application and include the fines. A photocopy will be sent as a reminder with the Order of Conditions.
ConCom Business – Phone Calls
- 344 Main Street. Neighbor may remove dividing area. The resident spoke with C. Keene and J. Stewart on Monday night.
- Center Street – ConCom was informed that they plan to expand a riding facility. Will require a phone call to homeowner.
- Main St. – A neighbor complained about their neighbor filling in wetlands. M. Dempey checked the maps, and there were no wetlands there.
- Johnson’s Pond – Dr. Jim Manganiello invited M. Dempsey to attend a meeting on Monday night regarding what Boxford is going to do with Johnson’s Pond.
New England Power Company – continued

Hearing opened 7:32 pm. A site walk was conducted on 4/25/09 with T. Grim, T. Schaefer, and M. Dempsey. M. Devlin submitted amendments, a 3 plan set, as discussed at the site walk. The amendment is that they removed swamp mats by vernal pool. P. Richard summarized the project. M. Dempsey reviewed the site walk comments with the commissioners. Paul Richards requested a waiver from the seasonal restriction, working 9 out of 12 months. P. Richards will need to apply for a blanket Seasonal Restriction Waiver and will need to negotiate a pre-arranged fee rate. ConCom also would require our inspector to go out there every 2 weeks. P. Richards will contact ConCom when trees are flagged, when the pole will be removed, and when erosion
controls are in. P. Richards also requested a draft OOC be sent to him. M. Dempsey will send the draft OOC to P. Richards and the Commissioners for comments. P. Richards requested the OOC be written as New England Power Co. – not National Grid. M. Dempsey made a motion to continue the hearing to June 10, 2009. T. Grim 2nd. All in favor. Unanimous. River Pines – NOI, GNOI – Town of Groveland
Present: Michael Seekamp, Seekamp Environmental Consulting; Selectmen Dan Greaney
Hearing opened: 7:53 pm. DEP# 030-391. Applicant submitted tear sheets and green cards. This is an after-the-fact filing for impacts and alterations to vegetation within the 200’ buffer zone to the Merrimack River. The poles that have accumulated for many years have been hauled away to a proper facility, the seashells have been moved out, the dirt pile has been moved out of the 200’ area, the haybales have been put in, they left the existing haybales they had in, the area where materials have been stored has been seeded and mulched. It looks stable with no sign of erosion. All work is now done outside the 200’. They propose transplanting some of the trees along the top of the hill to the fence area along the Babe Ruth field.
M. Seekamp said 6600’ sq. ft. area was affected, trees were cut, but stumps were not pulled out. He prepared a restoration plan, proposing to augment stump sprouts of birches and white pines. He proposed to monitor growth of vegetation in the area for two (2) years.
D. Greaney said they’ve been meeting with the Light Department regarding installing light poles for the softball field. Two poles are within the 200’ area. Michael Cloutier sent ConCom a letter regarding the six (6) light poles. The light poles will be incorporated into the Order of Conditions.
They have not had a response from Natural Heritage regarding their MESA review. Tree planting may need to wait until October. T. Grim made a motion to continue the hearing until June 10, 2009. M. Dempsey 2nd. All in favor. Unanimous. Hearing closed 8:06 pm.
Lot 24, 3 Stonebridge Road, cont.
Present: Greg Hochmuth
Hearing opened 8:07 pm. The project is a duplex home. Originally a SFH in 2004,but the house didn’t sell, and the OOC is expiring. The square footage is smaller than the previous filing. It is also further away from the wetlands. A site visit was conducted. The sewer has been graded differently because T. Grim noticed a mistake with the last plan. Marked on the map where granite markers need to go per ConCom and DEP’s comment. T. Grim asked him to remove debris that was behind the lot, and G. Hochmuth agreed. T. Grim made a motion to approve the project and issue a permit based on the application. S. Benanti 2nd. All in favor. Unanimous. Hearing closed 8:14 p.m.
18 Stonebridge Rd., cont.
Present: Greg Hochmuth
Hearing opened 8:14 pm. A site visit was conducted. Previously, the Commissioners asked if he could pull the project further from the home away from wetlands. G. Hochmuth said they regraded and are clearing 45% less than the previous plan. They moved the limit of work line away from the wetlands. The slope will now be 1:1 boulder slope instead of 2:1. They will have a larger flat back yard. They are moving 1 marker because they are re-grading there, moving it to the edge of the woods so it won’t be in the middle of the lawn. Slope is twice as steep and cutting into the yard to make a flat area. T. Grim marked on the map where he’d like the granite markers placed. One new marker and one relocated marker is shown in blue on the map. M. Dempsey made a motion that ConCom approve changes to 18 Stonebridge Road, and grant a permit with conditions as discussed in line with the plans. T. Grim 2nd. All in favor. Unanimous. Hearing closed 8:29 pm.
Center Street, Lot 41, cont.
Opened 8:30 pm
Present: James Bussing. Numerous abutters.
M. Dempsey read his notes from the site visit conducted on April 11, 2009. They noted that the stream spread out and flowing away from the property. The proposed drainage looked like it was going to flow toward the stream, headed to Argilla Brook and away from abutting properties. Owner, Jim Bussing said there are no changes to the plan since the last time. T. Grim will mark a swail on the map to be included in the project, to prevent water from flowing toward abutter’s property. J. Bussing asked that the swail be closer to the lot line. T. Grim drew on the map where it will go. T. Grim made a motion to accept the plan and issue an Order of Conditions based on ConCom’s discussions. M. Dempsey 2nd. All in favor.

83 King St. – Informal Hearing
Present: Henry Wong. Informal hearing opened 8:40 pm. H. Wong wants to build a garage behind his house. He spoke with C. Keene and J. Stewart Monday night. C. Keene saw wetlands on the property. T. Grim will conduct a site visit tomorrow at 7:30 am.

Open Space & Trails Committee –
Present: M. Camp; R. Lombard; B. Guptill; G. Blatt
Opened 8:46 pm. The bridge was successfully installed, thanks also to C. Keene and T. Grim. A site walk was conducted this past Saturday with Georgetown people and Land Agent Sue Gagnon of the Div. of Fish and Wildlife. Commissioner Sue Sexton attended the site walk too.
Meadowpond: Police caught four young kids riding dirt bikes in Meadowpond. M. Dempsey asked the parents if they wanted to pay the fine or work 28 hours community service time; 7 Saturdays for 4 hours. All agreed to do the community service. The kids will clear brush and trash from trails. M. Dempsey will email Commissioners about volunteer work at Town Forrest.
Trails and Marking: They proposed simple markers inside Meadow Pond to prevent people from getting lost. People take wrong turns at cross trails. Open Space wants to put small markers with numbers on trees. People would then be able to use a trail map to work their way through the land.
Kelly Property: It was approved at Town Meeting. Bob Guptill has been talking with the family. M. Dempsey emailed Greg Labrecque. Town Counsel will need to do title search, contact Consoli, etc. to close the deal. M. Dempsey will contact the lawyer so that the sale can be completed. The purchase and sale has a time frame attached on it. Greenbelt is all set to send a $10,000 check.
Webster Property: Mike Dempsey and Bob Guptill met with two of the Webster brothers. They had a good meeting and will meet again in June to hopefully negotiate a final price to get a purchase and sale. The Town’s portion will be about $100,000.
