ConCom Business – Minutes
C. Keene made a motion to accept the minutes from July 15, 2009 and July 27, 2009, as submitted. M. Dempsey 2nd. All in favor. Unanimous.
Terry Grim arrived 7:13 pm.
ConCom Business – 13 Wood St.
Present: Dan Gugger, previous owner; Troy Schubert, current owner
Issuance of the Certificate of Compliance was postponed pending a site visit. T. Grim performed a site visit and said it looks mostly good. There is a small section where the soil is clay and rocky and vegetation hasn’t taken yet. There is a small bit of erosion. The replication area is solid as a rock and the bushes are beginning to kick in. The grass is in good shape. J. Stewart said it’s as stable as it will ever be. T. Grim felt it wouldn’t be any more established one year from now as it is now. J. Stewart said it had no erosion or wash-out areas. Needs top soil and to be seeded to finish stabilizing it. T. Grim recommends issuing the Certificate of Compliance. M. Dempsey made a motion that ConCom issue a COC for

ConCom Business – Center St. Problems – Informal Discussion
Commissioners discussed problems at Center St., specifically, the very end of Center St. in Groveland where Boxford and Haverhill come together. There’s a culvert and another pond there. Resident Jim Manganiello has been dealing with Haverhill people. M. Dempsey has also done some communication, however the resident is still not happy. C. McKee has address some of these things and requested that this be discussed at this meeting. There are many issues: parking enforcement, signage, problem with culvert being cleaned. ConCom’s issue is when people park there and they throw trash in the pond and when the beavers clog up the culvert and the pond overflows and gets polluted. ConCom has worked with Bob Arakelian to get signage up. Some efforts
have stalled. The resident keeps pursuing it. Concom does not have the resources to take care of the culvert and signage. J. Stewart pointed out that the resident is not a resident in the town of Groveland, and that these issues are police enforcement and Road Commissioner issues. M. Dempsey has issued permits for beaver entrapment. We’ve asked the Road Commissioner to put up signs. The resident is not faulting ConCom, but asking for more to be done. Selectman, Don Greaney asked if ConCom can issue a permit to the Highway Dept. to clean the culvert? ConCom has done it a few times in the past few years. T. Grim said the Town of Haverhill was willing to put tree trunks to prevent parking and contacted B. Arekalian, who didn’t show up at the meeting. Don Greaney suggested putting a beaver deceiver there.
River Pines – NOI/GNOI continued
Present: Selectman, D. Greaney
Opened 7:32 pm. The state declared no take of prohibited species. L. Felch read the minutes from May 13, 2009, meeting regarding transplanting trees. T. Grim said the silt fence needs to be tightened up. If not substantial re-growth as determined by ConCom by next June, trees will have to be transplanted. D. Greaney said all work should be done within 3 years. M. Dempsey will incorporate an inspection schedule, ie., twice a year. M. Dempsey made a motion that ConCom close the hearing and issue the Order of Conditions for River Pines as outlined in the minutes and based on the plan that was submitted by Seekamp. T. Grim 2nd. All in favor. Unanimous. Closed 7:41 pm.
66 Main st. Amendment to OOC/COC
Present: S. Bonarrigo
Opened 7:45 pm. ConCom issued an OOC back in 2005 to a previous owner who did not pave the driveway. The OOC has since expired and sold the home. Septic work has since been permitted there. S. Bonarrigo wants to sell the home and needs a COC and an Amendment to the OOC. M. Dempsey performed a site visit, and did not feel the paving was necessary. Commissioners discussed letting the driveway not be paved so than an Amendment and Certificate of Compliance can be issued.
M. Dempsey made a motion to issue an Amendment to the 2005 Order of Conditions, Section D, Item 3, to remove the requirement for paving, and change it to, “The driveway will be sloped and graded but will not be paved.” T. Schaefer 2nd. All in favor. Unanimous. M. Dempsey has done a few inspections to date and will do another site visit tomorrow. M. Dempsey made a motion to issue the Certificate of Compliance. T. Schaefer 2nd. All in favor. Unanimous.

0 Outlook Drive – NOI/GNOI – Project: Install Septic
Present: Peter Blaisdell, Hayes Engineering; Sheila and Stephen McAdams, owners, M. Mandarano, abutter
Opened 8:00 Submitted green cards. They did not submit tear sheets.
P. Blaisdell submitted photos. Project is a SFH 3 bedroom dwelling that needs repair of its septic system. Project will be 51’ from the BVW line. All work will be outside 50’ except for silt fence and associated grading. They want to repave the driveway. P. Blaisdell said no trees will be removed. T. Schaefer will do a pre-construction meeting. Commissioners discussed issuing an Emergency Order. Erosion controls must be in place before work is begun. Silt fence will be installed quickly. Emergency Orders are for 30 days. M. Demspey made a motion to issue an Emergency Order for this single family home septic system to begin 30 days on September 24, 2009, using the same basic conditions that ConCom plans on putting in a basic
Order of Conditions. T. Grim 2nd. ConCom reminded them of the seasonal restriction beginning November 1, 2009. All in favor. Unanimous. M. Dempsey made a motion to issue an Order of Conditions and permit for the driveway and septic system and associated grading within the jurisdictional wetland buffer. T. Schaefer 2nd. T. Grim noted the seasonal restriction and explained that they may need to file for a waiver. All in favor. Unanimous. Hearing closed 8:13 pm.
4 Marion Ave. –. GRDA – Meeting Re-Do
Carl Keene recused himself.
Present: C. Keene, A. Couillard
Opened 8:29 pm.
Al Couilliard requested to come to this hearing. The meeting is being redone at the request of Al Couilliard. Carl described the project. Project would be an extension to the trail and forming a loop, and installing a shed 50’ from the water mark. The only part not done is the 4 sona tube poles and shed.
Abutter Al Couilliard stated his issues with C. Keene’s former OOC dock and path project. Commissioners pointed out that this OOC has already been closed out with a COC. Other issues he brought up regarding machinery outside 200’, were outside the ComCom jurisdiction. Commissioners pointed out to him that the OOC has been closed, and that the appeal period is over.
Al Couilliard also had concerns with this project being an RDA. A. Couilliard disagrees the distance of the project, saying it’s within the flood plain. T. Schaefer pointed out that ConCom makes judgement based on whether there will be an adverse effect to the resource area. As a resident, he should be upset about the other filings too. A. Couilliard made other claims of hearing a chainsaws, etc. A. Couilliard wants this to be a DEP/NOI hearing. T. Schaefer pointed out that A. Couilliard that he wants ConCom to treat this resident differently than every other applicant. C. Keene said, for the record, that the accusations that A. Couilliard stated were untrue and lies.
M. Dempsey pointed out that this is a neighbor conflict and using ConCom as a battering ram to get back at the other person. C. Keene said he also believes it is a neighbor dispute. There is a lawsuit against A. Couillard. A. Couilliard claims he wants an enforcement issued and plans to go to the state. C. Keene said, for the record, he got approval for the trees that were taken down. ConCom disagrees with A. Couilliard on a number of counts, not to this specific case, but how ConCom does business. A. Couilliard is attacking ConCom on our ethics. M. Dempsey suggested A. Couilliard send his wetlands scientist at his expense. The Commissioners will not treat C. Keene any differently than any other applicant. M. Dempsey suggested ConCom conduct
a site walk. A. Couilliard wants to have an independent wetlands specialist at the site walk. C. Keene said, no, because of a court case and other neighborly disputes, he’s trying to find fault. Also the pictures show that someone was trespassing again. C. Keene pointed that if he wasn’t a Commissioner, it’s likely that we wouldn’t be having this conversation, because he’d have already had his permit and be done and moved on. It’s because we’re reviewing the application again and that everyone here is of the highest ethical standing that we’re having this conversation. Hearing continued until October 7, 2009. Site walk to be determined, tentatively Friday, September 25th at 5:45 pm. Hearing closed 9:13 pm.

Stevenson’s Way Access to Meadowpond –
Present: Ed Kaznicki - Commissioners discussed how best to improve the situation at the end of Stevenson’s Way. Open Space will arrange a meeting and invite ConCom with a couple of abutters there to discuss plans for parking and trail head improvement.
Dan Wellehan left the meeting at 9:54 pm.
Ed Kaznicki – Requested permission to ride horses. ConCom gave him permission. ConCom will make a new file with horse riding permission forms, stating don’t ride when wet, do not have the horse gallop – walking/riding only.
Webster Property – Need to look for alternate resources for the purchase. Fish and wildlife isn’t giving ConCom money. Short $100,000 from the budget. M. Dempsey recommends sitting down with Greg Labrecque and bond Open Space money to purchase the property. Bond 10% CA funds and pay back.
Center St. Properties – Strawberry Field area. Greg Labrecque said developers pulled out and it fell through. Bob Guptill will follow through.
Town Forrest – M. Dempsey said they need to get a formal management plan put together. Can use some Open Space money to do it.
