ConCom Business - State land grant – signatures.
Concom Business – Piano
Commissioners discussed the work-in-progress regarding the piano at Veasey Park. M. Dempsey made a motion that the piano will be granted another year in the conference room so it can be repaired and refinished. The project needs to start by January 1, 2010 and be required to give status updates every 2 months. C. Keene 2nd. All in favor. Motion passed. Unanimous.
12 Merrimack River Rd. – NOI/GNOI – continued
ConCom received the letter from Natural Heritage. The applicant still needs to file with MESA. L. Felch will mail it to him. M. Dempsey made a motion that ConCom close the hearing on 12 Merrimack River Road dock and the issue a permit. T. Schaefer 2nd. 3 yes. 1 abstain. Motion passed.
120 Washington St. – GRDA
Present: Steve Shea, owner
The project is for a septic system. T. Schaefer performed a site visit and said it is sloped property. At the far back of home is Argilla Brook. The project is within 100’. The system has not been installed yet. The applicant was given an Emergency Permit. The Emergency Permit order states the project needs to be done by December 22, 2009. The applicant was told to call T. Schaefer when the haybales were installed. T. Schaefer made a motion that ConCom grant a permit for septic replacement at 120 Washington Street as discussed. T. Grim 2nd. All in favor. Unanimous. Closed 7:42 pm.
New England Power Co. – Seasonal Restriction Waiver Request –
Present: Paul Richards, Matt Devlin – Mason & Assoc.
Hearing opened 7:43 pm. Applicants discussed the soil borings for foundations and their locations. 5 are in upland areas. 3 are on the edge of wetlands. They will be using a tracked vehicle, minimal disturbance, going out sometime in January. Four days worth of work minimum. Before and after site visits. M. Devlin will contact T. Grim when work will commence. M. Dempsey made a motion to grant four (4) days of a seasonal restriction waiver to New England Power Company for work under the OOC in January, 2010, with optional additional days with a maximum of ten (10) work days. T. Grim will act as Project Manager. T. Grim 2nd. All in favor. Unanimous. Closed 8:02 pm.

4 Marion Ave. Dock – NOI

Hearing opened 8:03 pm. Applicant submitted tear sheets and green cards.
GRDA extended into an NOI. At the last ConCom meeting, Commissioners agreed to visit the site again and noticed he could reduce incursion into the bank to move it closer to the trail. The work has more detail on it with respect to the trail. C. Keene contacted an electrical contractor, and was informed that according to the rules and regulations, to effectively to get power to the shed, they cannot be more than 50’ apart and 12’ high. C. Keene would like to add three (3) hand-dug poles to run power. T. Schaefer asked if they would go along the trail? C. Keene said they would be between the shed and the 200’ mark. M. Dempsey asked him what size poles? C. Keene said 4x4,x 16’ tall (12’ tall exposed).
M. Dempsey read site visit report from September 25, 2009. T. Schaefer, M. Dempsey, S. Benanti, and T. Grim were present at the site visit. They observed the path, dock, and work under the previous GRDA permit, location of new shed, and connector turn-around path. M. Dempsey asked what the distance of connecting path will be? C. Keene said it would be less than 60’. Commissioners suggested every 20’, however, C. Keene would like to put in more rain stops because it’s steep. An inspection will be performed by ConCom within 60 days of commencement of work. C. Keene will notify the office when he’s ready to begin work. He also requested using a hand powered post hole digger power auger. Commissioners agreed to
allow that.
Al Couilliard brought his concerns to the attention of the Conservation Board, and each issue was addressed by the Board. He requested that the path be a walking path only, and not allow any motorized vehicles on it to maintain the waterbars. T. Grim recommends ConCom do site visits and view the water bars periodically, and if there’s any erosion that’s substantially in excess of what’s occurring in areas of the steep bank and surrounding the path, that they consider Al’s proposal. However, ConCom wants evidence that there’s substantially more erosion than is occurring on an everyday basis in other parts of the bank.
T. Schaefer made a motion that ConCom approve the plan dated September 28, 2009, with the stipulations outlined in M. Dempsey’s notes, ConCom specified site visits during constructions and comments; ConCom reserves the right to add, replace or adjust the water bars deemed necessary to stabilize in the entire pathway. T. Grim 2nd. All in favor. Unanimous. Closed 8:34 pm.
67 Center St. – NOI/GNOI

Hearing opened 8:41 pm. Applicant submitted green cards and tear sheets. Applicant wants to add 4’ to the deck and move the staircase to the other side and add 2 more footings. 5 or 6 sona tubes. Applicant was informed to not use large equipment , that the work will be done by hand or power auger only. Closest to edge of stream – 16’ at the closest – to the bvw – 10’. This is within 25’ no disturb zone. The deck was already there. DEP had no comments. Erosion controls – land disturbance is minimal. Applicant said staking haybales would be more disturbing. Site visit: Saturday December 19th, 9:00 am. Hearing is continued to January 13, 2010. M.
Dempsey made a motion to continue the hearing until January 13, 2010, after the December 19, 2009 site visit. T. Grim 2nd. All in favor. Unanimous. Closed 8:51 pm.
186 Washington Street – Extension to OOC

Hearing opened 8:53 pm. Previous OOC expired on December 6, 2009. Applicant filed for an extension before the expiration date. E. Gorski said the silt fence and double-staked haybales have been put in. He’s requesting a 10 month extension, from January, 2010 until October 31, 2010, which would give him 7 months to finish the home. Site visit is scheduled for December 19, 2009 at 9:30 am. T. Grim made a motion that ConCom grant an extension to the existing OOC as discussed for 186 Washington Street for 10 months. M. Dempsey 2nd. All in favor. Unanimous.
