Meeting called to order at 6:30 P.M. at Town Hall.
Present: Barbara A. Sheehan and Elizabeth A. Gorski
Absent: Chairman William H. Darke.
Concern with Zoning Code
Mr. Paul Bergman, Engineer for a property owner off of addressStreetKing Street, requested time on the agenda to discuss his concerns with the Zoning Bylaw’s inscribed 100’ circle section. Bergman stated that everyone has a different interpretation of the bylaw (Planning, ConCom, etc.) and the Building Inspector does not feel comfortable stating his own opinion and refers you back to the Chairman of the Planning Board. In the meantime, property owners who may have owned the property for years as a retirement nest egg are losing the use of much of their land. Bergman stated that the Consulting Engineer for the Planning Board interprets it “super conservatively” which can affect someone’s finances; that using the inscribed circle and the wetland bylaw compounds the problem and
ends up with a super conservative decision allowing only 4 lots when it could have been 5 developable lots.
Both Selectman Sheehan and Gorski told Bergman that they want the town to hire it’s own in-house Engineer but the Finance Director told them that won’t happen until the town knows where it stands with the school budget that still is not settled. Bergman stated he would be willing to write a form of the bylaw that would be understandable to the lay person and asked what the procedure is for amending the town’s bylaws. The Board’s Assistant informed Mr. Bergman that Cammett Engineering is currently working on re-writing the town’s zoning bylaws and she would check to see if that section is receiving attention.
Class II Used Car Dealer’s License
The Class II Used Car Dealer’s License for T & E Auto Sales had been turned back to the Town by Thomas Berube, former partner of Edward Cordeiro and whose sole name is on the $25,000 Bond required by Mass Law. Cordeiro had requested an opportunity to speak with the Board after their Assistant had sent a Police Officer to the site when she saw cars being sold over two weekends. Cordeiro told the Board there was a misunderstanding; that he and his partner had had a falling out and he didn’t realize that Berube would turn the license back. The Board’s Assistant reported that she had given a young man sent by Cordeiro a photocopy of the license when he had come by to pick up the original, explained that Cordeiro’s partner had picked up the original, and that she had
told the young man that the original license needed to be posted at the site where the cars where being sold from and if it wasn’t they could not sell cars; that she was told by the Police Officer that Cordeiro had a framed license which turned out to be a photocopy of the original. Cordeiro told the Board that the young man he had sent in for the license misunderstood their Assistant.
Cordeiro was given an application to re-apply for the license, telling the Board that he is bondable and will supply a bond as required. He will deliver the application to the Selectmen’s Office by Monday of the following week.
