Meeting called to order at 2:00 P.M. at Town Hall.
Present: Elizabeth A. Gorski and William H. Darke, Chairman.
Also present, Walter Sorenson, Chairman of Planning Board.
Lot #4, King Street
Town Counsel, Kathleen O’Donnell, recently sent a legal opinion to Building Inspector Pat Schena stating that in her opinion Lot 4 meets the minimum requirements for a single lot exemption because it was not held in common ownership with any adjoining land at the time of its creation. Sorenson disagrees with the opinion and gave the Board a briefing on this property and other parcels owned or previously owned by Nicholas Decoulous; that in the 1995 the Planning Board rejected the plan submitted and filed it’s rejection with the Registry of Deeds. Sorenson suggested that he had an earlier decision from Cheryl Burke at Kopelman & Paige stating that the lot was not a buildable lot; that the opinion was back in 1996 and 1999. Sorenson asked the Board for permission to speak to
Attorney O’Donnell about her most recent opinion and the previous opinions.
Sorenson was told to make a copy of the pertinent papers in the Planning Board file that backs what he has suggested and deliver them to the Board’s Assistant; that she will send the paper work to Attorney O’Donnell and ask her to review and respond as to whether her opinion would change. In the meantime, the Board asked their Assistant to notify the Building Inspector of Sorenson’s concerns and ask that he not issue any permits until clarification is received from Town Counsel.
